During the pandemic, a Canadian immigration pilot project extended permits for immigrants who did not announce family members on their original applications to yet sponsor them to arrive in Canada.
Despite the pilot, Immigration, Refugees and Citizenship Canada (IRCC) still requests all applicants who apply for Canada permanent residence to state all of their family members, though if they are not accompanying them to Canada. These family members comprise the candidate’s spouse, common-law partner, dependent children, or the dependent child.
These family members are typically subject to criminal and safety checks as well as a medical exam. In addition, IRCC states that the department officials have all the relevant information to decide on the application of Canada PR. As well, they will make sure that these family members won’t make the major candidate inadmissible or ineligible.
Moreover, on a Canadian immigration application regardless of whether the dependent lives with the applicant, the dependant’s fiscal burden is considered. In addition, applicants should show they have the funds to support family members under most Canadian immigration applications.
The penalty for not including family members on a permanent residence application was a lifetime prohibition on taking the family member to Canada, previous to the pilot program. Further, the IRCC says that to appreciate the immigration claimant’s full exposure, these guidelines were put in place. Likewise, these regulations can improve the family class immigration’s overall integrity, and protect the Canadian’s safety, health, and security.
Apart from that, the House of Commons Standing Committee raises the lifetime ban’s harshness concerns. As well, on September 9, 2019, a two-year pilot was introduced that allowed some undeclared family members to come to Canada.
IRCC Says Applicants Should Meet The Below Eligibility Criteria For The Pilot Program
They are applying to be sponsored as a common-law partner, spouse, or dependent child.
And, they were not acknowledged or observed when their sponsor became a permanent resident of Canada
- As a relocated refugee
- After being approved Canada's refugee protection
- As a dependent of a relocated refugee/protected individual
- Under the family class, after being sponsored as a common-law partner, spouse, marital partner, or dependent child or
- In Canada class, after being sponsored as a common-law partner or spouse under the spouse or common-law partner.
Also, IRCC says this pilot project only applies to family members who wouldn’t have made their sponsor unqualified to settle in Canada
Furthermore, due to the travel restriction’s impact on people’s lives, the pilot was then extended during the pandemic of COVID – 19. Though IRCC still needs all permanent residence candidates to announce their family members on their application, the project now remains in effect until September 2023 and could be extended.
Who All Are Not Eligible For The Pilot Project?
The applicants are not eligible for the pilot program if:
- They were not mentioned or observed when their sponsor became a PR of Canada.
- In a financial class (including as a caregiver)
- After being sponsored in the family class other than as a partner, spouse, or child (for example, parent/grandparent and their dependents, other relatives)
- In the permit holder category
- As a claimant in Canada based on humanitarian and empathetic grounds.
Or
When they applied, they would have made their sponsor unqualified to immigrate to Canada for example, if the sponsor
- Immigrated as a spouse, but was wedded or in a common-law connection with the applicant at that time
- Was wedded or in a common-law relationship when they came as a dependent child on their parent’s application or
- Came to Canada under a program that needed them to be single, with no dependent relatives.
Applicants only wishing to apply under the pilot project require to apply to the normal programs to sponsor a partner, spouse, or child.
