When hiring a temporary overseas worker in Canada, a (Labour Market Impact Assessment) LMIA is required. Though, based on the situations around the overseas worker’s hiring, there are 6 specific applications that companies can avail.
As part of recruiting a temporary foreign worker (TFW) in Canada—under the Temporary Foreign Worker Program (TFWP)—firms have to submit a Labour Market Impact Assessment (LMIA) request from Employment and Social Development Canada (ESDC). Also, to hire a foreign worker this document is required, and fix the effect of their employment on the Canadian labor market; but, there are distinct applications for specific circumstances in which companies want to hire a skilled foreign employee.
These specialized applications have their own set of processing times, eligibility norms, payments, and necessities. They are available for the following six conditions
Express Entry
This express entry application is for companies that need to support their TFW’s application for Canada permanent residence (PR). Under this system, bosses help sponsor their worker(s) (previously residing in Canada legally, as a temporary resident) so, they would gain the essential one year of full-time work experience and then be qualified to apply for PR through the programs of Express Entry system. Significantly, though, there is a distinct system for Quebec, with its considerations and programs.
Global Talent Stream (GTS)
The GTS is a special immigration program that is kept for skilled overseas workers that know STEM or technology fields. These workers should have skills that are extremely in demand or rare in Canada, to be considered. These TFWs are also classified as high-wage (National Occupation Class (NOC) A, or B) with yearly pay of a minimum of $80,000. Under the GTS, firms can also apply for extended employment periods (up to three years) and have to submit a Labour Market Benefits Plan (LMIB), along with an LMIA), signifying how the specific company applying practices will have a completely positive impact on the Canadian labor market. The GTS does also feature a benefit for the additional paperwork, including
- Quicker processing times with a service standard of 10 working days —this standard is predicted to be met a minimum of 80% of the period;
- Personalized high-touch support through the process of assessment;
- Eligibility to have work permits for extremely skilled workers to be managed in two weeks—this standard is likely to be met a minimum 80% of the time; and;
- The capability to add, and/or change numerous names on a positive GTS LMIA, with processing standards within 15-20 working days of the application update.
Positions in Quebec
To regulate economic immigration to the province, Quebec has its separate program(s) that is known as the Regular Skilled Worker Program (QSWP). LMIA’s will be submitted to Service Canada, and the Quebec Immigration Ministry instantaneously. At the time of this writing, Quebec has arranged certain professions and suspended other roles at least marketing necessities.
Academics
Academics are well-defined as any person with a minimum of one post-graduate degree who gets the majority of their revenue through teaching or leading study as a university/university college worker. If the criteria are met, then some of the occupations can even work in Canada without companies demanding an LMIA (while certain others will not want a work permit also). As well, Citizens of the United States, Greenland, and St. Pierre et Miquelon may apply for a work permit at Canada’s entry port (if wanted).
Agriculture
Agriculture is formed for Primary Agriculture field laborers. In addition, this program permits TFWs to work in Canada as agriculture employees in a farmhouse, garden center, or greenhouse. From January 12th, 2022, to June 30th, 2023, ESDC will suspend the lowest marketing necessities that make it simple for firms to hire overseas workers in these fields. However, these roles are for lower-wage positions and NOC classes habitually, so subsequent immigration for PR may be impacted as an outcome.
Caregivers
For children below the age of 18, or individuals with higher medical requirements (people 65 or older, or people with disabilities, chronic, and/or incurable illnesses) families can hire live-in caregivers under the TFWP. The qualified professions could comprise nurses, home care workers, live-in caregivers, and personal care assistants. Workers under this program have to offer care on a full-time basis, work in the private home where the care is being provided, and meet the necessities set for by ESDC, and IRCC.
